Terms and Conditions

  1. Information on how to enter and subscribe form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of entry.
  2. The Promoter is Breville Pty Ltd trading (ABN: 98 000 092 928) Ground Floor, Suite 2, 170-180 Bourke Street, Alexandria NSW 2015.
  3. The promotion will run until 500 consumers have entered and successfully downloaded the Surprise Cake App or while stocks last.
  4. The promotional code will allow consumers who register to download the Surprise Cakes App from the iTunes store, App store or iBooks. An Apple ID is required
  5. Entry is open to all residents of Australia who are 18 years of age or over. If the entrant is under 18 years old, you must have your parents’ permission to enter. Employees and their immediate families of the Promoter, participating outlets and their agencies associated with this promotion are ineligible.
  6. To be eligible to download the How To Cook that Surprise Cakes app, entrants must do the complete their details and accept Terms and conditions.  
  7. Personal information will not be supplied to any third party organisation. It is for the use of the Promoter only.
  8. Each Surprise Cakes App is valued at $ 4.49 each
  9. Entrants will only be able to download a maximum of one code will be one person
  10. The Promoter accepts no responsibility for any variation in the value of the prizes. All prize values are in Australian dollars.
  11. Entry is only open to Australian residents.
  12. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.breville.com.au/privacy-policy.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, if an entrant selects the ‘Please send me news and promotions from Breville’ tick box at the time of entry, for an indefinite period, unless otherwise advised, use their PI for promotional and marketing purposes, including sending electronic messages or telephoning that entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia
  13. The Promoter reserves the right to use winners’ names for promotional purposes only. All entries and information relating to the competition remain the property of the Promoter and can be used to further promote the brand and its associated products.
  14. The Promoter is not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorized access to or alteration of entries.
  15. The Promoter is not responsible for lost, late, incomprehensible or incorrect entries in the promotion. You should seek independent financial advice about such matters.
  16. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, the promoter is entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from any applicable regulatory authority.
